Divide marital property in Ukraine while living abroad

A flat, a house, land, a car or a business share. We analyse the property and the other side’s position, show the options — an agreement or a court — and follow the chosen route. Together with a divorce, if needed. Family matters stay confidential.

Three years after the divorce

A claim to divide property after a divorce is subject to a three-year limitation period, counted from the day you learned or could have learned that your right was violated (Art. 72 of the Family Code of Ukraine).

When clients come to us

  • You are divorced, but the flat is still registered to one or both of you
  • You are divorcing now and want to settle the property at the same time
  • Your spouse is in Ukraine and does not respond
  • There is a joint business or company shares
  • A court has already ruled in a way that does not suit you, or the ruling is not enforced

How it works

  1. Stage 1 — analysis and position

We check the property in the registers, determine what is joint, and propose a route: a division agreement or a court.

  2. Stage 2 — agreement or court

We conclude the agreement with a notary or represent you in court. The price of this stage is fixed after stage 1.

  3. Registration

We register the property rights according to the division.

Analytical, comprehensive, confidential

What we analyse before proposing a plan

  • What is joint property and what is personal
  • The real value of the property and the shares
  • The other side’s position and possible actions
  • Tax consequences of the division and of a later sale

Who we bring in and coordinate

  • A valuer of real estate and businesses
  • A notary — for the division agreement
  • A tax adviser
  • Corporate lawyers — if there are company shares
  • A translator

You deal with one responsible lawyer who also leads the team.

Confidentiality from your first message

  • The very fact that you contacted us, your documents, property and plans are protected by attorney–client privilege (Art. 22 of the Law of Ukraine «On the Bar and Practice of Law»).
  • The law prohibits demanding privileged information from an advocate or questioning them about it (Art. 23 of the same law).
  • 16 years of practice since 2010: client confidentiality is a rule without exceptions.
  • Only your lawyer and the specialists we bring in with your consent know about your case — under a confidentiality obligation.

Questions and answers

Do I need to attend court?
A lawyer represents you in court, so your personal attendance is usually not required. We will confirm this at the diagnostic consultation.
Can you represent both spouses?
No. We represent only one side in a family.
Why is the price of the court stage not known at once?
The amount of court work depends on the property and the other side’s position. So first a fixed price for the analysis, then a fixed price for the court stage.
